WALDECKS GARDEN CENTRES GIFT CARD TERMS AND CONDITIONS
All Waldecks gift cards are valid from 12 months after the date of purchase. Any stored value remaining on a card after this date will not be available to the card holder and our system will not accept your card. This is not the case for any cards that are topped up, any added value will extend your credit for a further 12 months from the date of top-up.
By placing an order for purchase of gift cards via this website ("Order") you are agreeing to the terms conditions set out below.
GIFT CARDS GENERAL
1.Gift cards are subject to the Gift Card Use Terms and Conditions, which are available on our website, owned and operated by Nursery Australia Pty Ltd.
2.Your gift card will expire 1 year from the date of issue as indicated on your receipt. Unused value may not be refunded.
3.Each Order (once accepted) represents a separate Agreement incorporating the terms of that Order, including these terms and conditions and the Gift Card Use Terms and Conditions. In the event that there is a conflict between these terms and conditions and the Gift Card Use Terms and Conditions, the Gift Card Use Terms and Conditions will prevail to the extent of the inconsistency.
4.You may place an Order by following the instructions on the Website. Your Order will be submitted when you complete your payment details and indicate your acceptance by activating the "Pay Now" button. Orders will be deemed to have been received by us at the time we send an Order confirmation to your nominated e-mail address.
5.You may place an Order for up to 50 Gift Cards in one Order, with a total value not exceeding $10,000. A minimum value of $10 and a maximum of $995 can be loaded on each Gift Card. We may change the minimum and maximum amounts that can be loaded onto a Gift Card from time to time at our sole discretion.
6.We reserve the right to not accept Orders, including those for commercial quantities of gift cards. If we are unable to supply your total order, we will endeavour to contact you to discuss whether you wish to proceed with the part of the Order.
7.We reserve the right to cancel any Order at any time, without notice, for any reason.
8.If you wish to cancel an Order, you must immediately notify our Gift Card Team on 08 9254 6700 during business hours, quoting the receipt number. Orders that have already been processed cannot be cancelled. Where possible, we will endeavour to process cancellation requests and provide you with a refund, but we will not be liable for any failure to do so.
9.You acknowledge that the internet can be an unstable and, sometimes, insecure marketplace. At times the Website may not be available; or Orders may not be processed or may not be accepted for reasons beyond our control. In these circumstances we accept no responsibility. We do not warrant and cannot ensure the security of any information transmitted, or a person on your behalf transmits, to us. Accordingly, any information which you transmit to us, including your credit card details, is transmitted at your own risk and we are not responsible while such information is in transit.
1.Payment for Orders is to be made by Visa or MasterCard credit and/or debit cards.
2.Where you have elected to pay for your Order using:
a.a credit card, we will process payment for your Order once you click on "Pay Now", plus any delivery charges, and service fees as itemised on the final screen which indicates your acceptance of this contract (Total Amount) using your nominated credit card via a secure payment gateway. You authorise us to debit the Total Amount from your nominated credit card. If your nominated credit card is declined by your financial institution, we will not be required to fulfil the Order, and may contact you to make alternative payment and delivery arrangements;
b.direct deposit, you will be provided with our bank account details and a reference number. You must include the reference number with your bank transfer otherwise your order may be delayed.
3.We may decide at any time not to accept payment from you for any reason. If we decline to accept payment, we will not process the Order and may not contact you to inform you that your Order will not be processed. We will not process any Order until the payment has been received and will not be liable for any delay from banking delays or misdirected payments.
DELIVERY, RISK & TITLE TO GOODS
4.Gift Cards are only available for delivery within Australia. All Orders are delivered via Australia Post to a nominated residential or business address. Gift Cards cannot be delivered to a P.O Box or Locked Bag address.
5.Australia Post are sub-contracted to us for carrying out delivery of Gift Cards ordered online. Any issues regarding delivery of Gift Cards should be referred to our Customer Service team on 08 9254 6700 during business hours or firstname.lastname@example.org.
6.We will not be liable to you or anyone else for any losses suffered or incurred due to delay in delivery or for any lost or misdirected Gift Cards, including any Gift Cards lost or misdirected in the mail.
7.Subject to payment, property and risk in the Goods passes to you upon dispatch of the Goods to your nominated delivery address.
9.You acknowledge and agree that by providing us with any personal or proprietary user information through the website or by any other means, you consent to the transmission of such personal or proprietary user information to us and relevant third parties, as necessary, for processing and activating your Order.
All Waldecks gift cards expire 12 months from date of purchase, for reference this is the date listed on your emailed receipt. After this date all value remaining on the card will be invalid for use.
If you let another person use your gift card, you must tell them that they will be bound by these terms and conditions. WA law applies to this agreement. By entering into this agreement, you unconditionally submit to the jurisdiction of the courts of WA.
1.Gift cards may be used to purchase goods or services at all Waldecks shopping centres in Australia with “EFTPOS” facilities, when the retailer elects to accept the gift card and the gift card has enough unused value to make the purchase. We are unable to guarantee the acceptance of Waldecks gift cards at Lakeview Café. No Waldecks gift cards are accepted at Blue Lotus Café or Lakeview Cafe.
2.Gift cards purchased online will be activated 10 days after purchase. If a gift card is believed to be lost after being posted, you will need to inform our gift card team on 08 9254 6700 or by email email@example.com. Our team will cancel the gift card and re-issue. Gift cards cannot be redeemed for cash, cannot be used for cash equivalent transactions (such as bill payments, purchase of financial products or foreign currency, or gambling transactions), returned for a refund or have their balances consolidated to a new gift card. We may in our sole discretion elect to cancel a gift card or block such a transaction if you attempt to do so. Gift cards are not legal tender, account cards, credit or debit cards or securities.
3.Keep your gift card secure and treat it as you would treat cash, anyone holding the gift card can use its value to make purchases. If your gift card is lost or stolen, or you suspect an unauthorised transaction, immediately report this by calling 08 9254 9700 (during Perth business hours). We may be able to stop gift card value being used, but require the card number, original balance and expiry date.
4.We may replace a faulty, lost or stolen gift card. Any replacement gift card will have the same unused value (at the time of replacement) and expiry date. Call 08 9254 6700 (during Perth business hours). You must present the original receipt). Gift cards will be void if they are defaced, mutilated, altered or tampered with in any way. We may subject gift cards to verification and security checks in our absolute discretion.
5.If you have a query or complaint about the gift card, please raise it through any of our contact channels. We are not liable for the availability, quality or fitness for purpose of any goods or services purchased with the gift card. Any dispute about goods or services purchased with the gift card must be resolved with the supplier. Except for rights which cannot be excluded, any conditions or warranties implied or imposed by legislation or otherwise are excluded from these conditions of use. To the extent permitted by law, our liability is limited to replacing faulty gift cards.
6.If you think there has been a mistaken transaction on your gift card contact the store where the mistake was made.
7.We may cancel any gift card, or the gift card scheme, for any reason at any time without notice. If so, we may either provide a refund or a replacement gift card of equivalent value unless we reasonably suspect fraud in relation to a gift card. The gift card remains our property.
8.We can vary or replace these conditions from time to time (including to introduce new fees) by publishing a notice in a newspaper circulating throughout Western Australia at least 30 days before the change.
9.After the gift card has expired, it is no longer valid and all transactions will be declined. Unused value may not be refunded and may become our property.
